Data protection of persons under criminal proceeding and protection of journalism information sources

On April 8th 2015, Kosovo Judicial Institute in cooperation with Thompson Foundation conducted training on “Data protection of persons under criminal proceeding and protection of journalism information sources”.

Purpose of this training was to enhance professional knowledge of participants related to implementation of best practices in handling personal data of persons under criminal proceeding and acquaintance with the case law of the European Court for Human Rights.

The training elaborated the Law on Protection of Journalism Sources and role of the Personal Data Protection Agency in protecting personal information.

At this training, an international expert presented focusing on case law and standards of the European Court on Human Rights, with the purpose of informing participants with best practices in protection of data and the sources, and incorporating these practices in actual domestic case law.

Role an importance of the European Court on Human Rights to freedom of expression and free press, role of the media and boundaries they have to respect related to freedom of expression and impact of the state in protection of sources were all topics elaborated during this training.

IN this light, also the court order for disclosing the information source was elaborated, as well as the order for disclosing documents when there is a major public interest on certain issues.

Participants were divided in working groups and conducted trial simulation in front of the Europeans Court of Human Rights on two case studies assigned by trainers.

Beneficiaries of this training were judges, prosecutors, lawyers, members of the Independent Media Commission and of the Press Council, as well as BIRN representatives
