Implementation in judicial practice of Article 3 on Protection of Human Rights and Fundamental Freedoms

On 31 May 2016, Kosovo Judicial Institute with the support of Council of Europe Office in Prishtina has realized training on the topic: “Implementation in judicial practice of Article 3 on Protection of Human Rights and Fundamental Freedoms”.  

The purpose for treatment of this topic was to deepen the beneficiaries’ knowledge about the application of Article 3 of the Convention and the experience of the European Court of Human Rights regarding this article, which is incorporated as part of internal law and is being applied directly without necessity for issuing additional legal means by any other state authority.

The focus of this training was the elaboration of Art. 3 of the ECHR in general, the absolute nature and basic principles of this Article, torture in prison, conditions of detention, medical treatment in detention on remand fines,  extraditions as well as inhuman and degrading treatment. Furthermore there were treated positive and procedural obligations deriving according to Article 3.

In the training were introduced dilemmas and questions that were addressed through a partial theoretical explanation, based upon cases and using concrete examples from the judicial practice of the ECHR. There were used exercises, discussions and case studies on violations of Article 3 of the European Convention.

The beneficiaries of this training were judges of basic level as well as prosecutors of the basic and appellate level.
