Training program in non-judicial institutions, visit of newly appointed judges and prosecutors to the "Constitutional Court"

On February 16, 2023, as part of the Program on visits to non-judicial institutions for newly appointed judges and prosecutors, the Academy of Justice visited the "Constitutional Court".

In the opening speech, the President of the Court, Mrs. Gresa Caka Namani first welcomed the newly appointed judges and prosecutors, describing the purpose of this visit as appropriate and at the same time highly appreciated the cooperation with the Academy of justice, to then continue the discussion regarding the topics and questions that have been of interest of judges and prosecutors, the topics that were addressed during the visit/training were: incidental referral of cases by regular courts, reasoning, as part of the right to a regular trial, criteria for a trial in a reasonable time and judgments of the CJK as precedent for other cases.

In the focus was also a dilemma of the participants, the question of whether the "Referral Court" is the sole judge, the president of the trial panel or the entire panel and whether the approval of the president of the Referral Court should be obtained for sending the case to the Constitutional Court? One of the advisors of the Constitutional Court answered these and other questions.

The training/visit was aimed at strengthening mutual capacities and exchanging best experiences, the methodology was interactive.

The beneficiaries of the training were the newly appointed judges and prosecutors (generation IX), where two of them were from the Bosnian community.
