Roundtable with Judges of the Appeal Court

On 17-18 October 2017, the Academy of Justice with the support of the UNDP Project “Support to Strengthening Rule of Law”, conducted a roundtable with judges of the Appeal Court with the purpose of presenting the finding of judicial practice research that derived as a result of violations, particularly in procedural and substantive civil cases, and consequently the courts of first instance fail to make a fair and lawful decision.

This round table was a continuation of the preliminary activities of this research project with a purpose of contributing to the avoidance of these violations through presentation of a handbook or manual in order to reduce the backlog of cases which are retuned to retrial, and increase the efficiency in case solving.

For two days, Judges of the Appeal Court, were engaged in this research project and individually presented the most frequent cases coming from first instance courts which, due to procedural and substantive violations, should be return to retrial.

On the first day, were presented findings and recommendations for issues identified on contentious procedure, the institute of statutory limitation, obstruction to possession and labor disputes, followed by ownership (profit by holding) servitudes, expropriation, cases of domestic violence, family and hereditary matters.

On the second day, were presented findings and recommendations related to issues identified on contracts, damage compensation, enforcement, and issues related to administrative conflicts.

During discussions, there were many issues for which the Court of Appeal had lots of dilemmas and were therefore required to be identified and address to the Supreme Court

From the joint discussions there were many issues for which the Court of Appeal had dilemmas and was therefore discussed to be ascertained and as such to be addressed to the Supreme Court.

At this roundtable participated the President of the Court of Appeal and other judges from General Department - Civil Division, Department for Administrative Affairs and Department for Commercial Affairs.
