Measures to ensure the presence of a minor in criminal proceedings

On September 10, 2019, the Academy of Justice in the framework of the Continuous Training Program conducted a training on “Measures to ensure the presence of the minors in criminal proceedings”.

The purpose of this training was to enhance the knowledge of participants by discussing and presenting best practices, as well as elaborating cases from practice to properly apply the legal provisions governing this area as well as educational measures and juvenile penalties.

During this training was emphasized that a juvenile who has violated the law may be ordered a temporary detention, police detention and detention only as a last resort for the shortest possible time. It was also noted that in practices often occurs that in the procedure against juveniles, detention as a last resort is not determined according to the manner and conditions foreseen by the JJC. Attention was paid to cases where the juvenile prosecutor proposes to the court to impose the measure of juvenile detention, including the legal requirements to be met for such cases. Therefore, joint discussions provided the best solutions in accordance with the legal provisions that regulate this area.

Beneficiaries of this training were: judges and prosecutors from juvenile department from different regions of Kosovo.
