TPP Jurisdiction of the appellate court judges

On February 4 and 5, 2013, KJI conducted a two day training where it addressed the module “The competence of the appellate judges”.
The purpose of this training was to familiarize appellate judges with their competences determined by the Law on Courts. Also another purpose of this training was the creation of best practices in the implementation of legal provisions when it comes to decisions on appeals against decisions of the Basic Courts.
During the training, besides the competences of special departments and divisions within the Court of Appeal were also pointed out the complaints against the judgments and decisions of the first instance, of the second instance as well as the types of decisions on the appeal against the first instance judgment. Also the wrong and incomplete factual situation and the decision on punishment as a legal basis for the annulment of the judgment of the first instance were addressed.
