Judicial procedure in expropriation cases

On June 15-16, 2020, the Academy of Justice in the framework of the Continuous Training Program, in cooperation with GIZ / LARP - Project for Legal and Administrative Reforms, is conducting training on "Judicial procedure in expropriation cases".

Trainers engaged in this training are: Mr. Erdogan Haxhibeqiri, judges of the Supreme Court and Mr. Shukri Sylejmani, Judge of the Supreme Court.

The purpose of this training is to advance the knowledge of the participants regarding the expropriation procedure, identification of the preconditions for expropriation and the applicable criteria for expropriation.

The training focused on: Legal conditions for expropriation, expropriation procedure in cases where the expropriating body is the Government or the Municipality, preliminary and final decision on expropriation, as well as legal remedies, manner and criteria for determining compensation in cases of expropriation.

During the training are also elaborated: Expropriation of immovable property, expropriation procedure in cases when the expropriating body is the Government or the Municipality, preliminary and final decision on expropriation and legal remedies, legal remedies, restrictions on property rights by the ECHR and Kosovo Constitution, compensation assignment, compensation payment, determining the compensation value, evaluation methods.

The training methodology is based on interactive discussions, elaborating various cases from the case law.

Beneficiaries of this training were: Judges from the Supreme Court, the Court of Appeals and Judges from the basic level.
