Civil Aspect of the International Child Abduction

On 10 December 2015, Kosovo Judicial Institute within CTP, conducted training on: “Civil Aspects of the International Child Abduction”

The purpose of this training was to deepen the knowledge of judges on the Convection on Civil Aspects of the International Child Abduction and national legislating issues on international child abduction, as well as proceedings for the return of the child on the requesting state and development of the analytical skills on implementation of the national legislation in line with international standards.   

In this training were also treated topics such as removal and retention of the child, conditions to be considered as international child abduction, competent bodies for development of the procedure for returning the child, role of the Ministry of Justice, Kosovo Police competencies, Center for Social Work, child voluntary return proceedings.     

In the afternoon session were addressed the role of the Court is in Pristina regarding international child abduction, commencement of court proceedings before the competent court, interim measures, when the order for return is excluded and execution of the decision for returning the child. During the last part of the training were treated the interim measures which may be issued with the purpose of insuring the return of the child and cases when the court may refuse the return of the child to the requesting state.

Training methodology was focused on theoretical followed by practical cases and concrete examples on how to apply the main rules of Hague Convention on Civil Aspect of International Child Abduction. During the training participants had the opportunity to discuss interactively the aforementioned issues.

  discussions and interactive debate, comments, notes, practical examples on the principles and basic rules of the Hague Convention on the Civil Aspects of International Child Abduction and law on the Civil aspects of International Child Abduction of Kosovo, on issues dealing with the return of the child.

Beneficiaries of this training were judges of general departments (civil and penal divisions) of Basic Court and prosecutors from juvenile department and basic prosecution office.
