Co-litigation and interferers in the proceedings

On February 11, 2016, within the Continuous Training Program (CTP), the Kosovo Judicial Institute has conducted training on the topic "Co- litigation and interferers in the proceedings".

The purpose and significance this training rely in the fact that it is assessed necessary for judges of civil field to make advancement in their knowledge about co-litigation as legal institute, which in practice may appear in quite complex mode, as well as to simultaneously deepen knowledge about interferers when they occur in the proceedings, in the function of righteous application of the proceedings and taking decision based on merits.

Initially, within this training it was discussed co-litigation as quite complex procedural element, mode of establishment of  co-litigation, types of co-litigation and effects that creates each co-litigation type in the contentious procedure, procedural position of co-litigants, their actions and the consequences caused by these actions.

In the second part of the training, the focus was mainly on the elaboration of the participation of third parties and interferers in the proceedings, types of interferers, conditions anticipated by LCP to allow the interference, the timing of interference and the difference between ordinary interferer and main interferer in the procedure. In this context, it was treated and discussed the judgment’s effect toward co-litigants and interferers in the contentious procedure.

The beneficiaries of this training were judges of basic level as well as professional associates.
