On February 15, 2015, within the Continuous Training Program (CTP), the Kosovo Judicial Institute has conducted training "Initial Hearing, Second Hearing and Judicial Hearing".
The purpose of this training was the advancement of participants' knowledge regarding criminal procedure that takes place after the prosecutor has filled the indictment and the elaboration of the CPC provisions that govern the conduction of the initial hearing, second hearing and judicial hearing in function of the efficient application of procedure in these phases.
Initially, within this training it was treated initial hearing and second hearing, deadlines for appointing the initial hearing after receiving the indictment and the second hearing, the actions of the presiding judge or single trial judge and the course of the initial hearing and second hearing, the participants in the initial and second hearing and actions between the initial and the second hearing. In this context, there were elaborated criteria on the occasion of pleading guilty, options after pleading guilty and the cases of separation of procedure when there are more defendants and some of them plead guilty at the initial hearing and some others did not plead guilty. Further, there were discussed the objection to the evidences, the answer and decisions to these objections as well as the requirement and circumstances of turning down the indictment at this stage.
The training was also focused on treating judicial review as one of the most important stages in criminal procedure, the stages of judicial review, tasks and actions of the presiding judge or a single trial judge in the judicial hearing, as well termination and delay of the judicial hearing. It was also elaborated the sequencing on administering of the evidence, interrogation of witnesses and inductees, as well deadline is completion of the judicial hearing.
The beneficiaries of this training were judges and prosecutors of basic level.
