Mediation in civil, criminal and economic terms

On May 20-21, 2020, the Academy of Justice in the framework of the Continuous Training Program and in cooperation with the USAID Program - Commercial Justice, implemented by CHECCHI and COMPANY are conducting training on: "Mediation in civil, criminal and Economic terms ”- Region - Gjakova and Prizren.

Trainers engaged in this training are: Mrs. Makifete Saliuka - Deputy Chairman of the Kosovo Judicial Council, Mr. Besim Kelmendi - Prosecutor in the office of the Chief State Prosecutor and Mr. Yll Zekaj - Mediator.

The purpose of this training was to advance the knowledge of participants regarding the novelties brought by the Law no.06 / -009 on mediation, and easier identification of appropriate cases to refer to the mediation procedure.

The focus of this training is the referral of cases in the mediation procedure that is at the discretion of judges, not ignoring the will of the parties to the dispute and in accordance with the relevant legal provisions. This training serves as an orientation for judges and other staff of courts and prosecutor's offices to more easily identify the appropriate disputes to be developed in the mediation procedure, as well as other cases for which compulsory mediation is provided.

During this training, the following principles are elaborated: principles of mediation, initiation of mediation procedure, mandatory mediation, procedure and obligations of judges, development of mediation procedure, mediation agreement and its effects, rights and obligations of the parties to the mediation procedure.

Applied methodology was of a combined character, with theoretical explanations and interactive discussions.

Beneficiaries of these trainings were: Judges, prosecutors, professional associates and mediators from the region of Gjakova and Prizren.
