The Academy of Justice in cooperation with the Council of Europe invites legal professionals to apply for the Course on the topic: “Right to Liberty and Security / Article 5”, on the HELP platform.
The right to liberty and security is a fundamental human right, essential for democratic societies. It holds a key position in the European Convention on Human Rights (ECHR), specifically in Article 5, which provides protection against arbitrary or unjustified deprivation of liberty. The European Court of Human Rights (ECHR) plays a crucial role in the interpretation of this article, providing detailed guidance on the safeguards required against arbitrary detention.
Under the EU framework, the right to liberty and security is enshrined in Article 6 of the Charter of Fundamental Rights, protecting individuals from arbitrary detention. The European Arrest Warrant (EAW) facilitates extradition between Member States, but must respect these rights by ensuring that any arrest or surrender is lawful and proportionate.
This online HELP course is designed to equip judges, prosecutors, paralegals, legal officers and other legal professionals with the necessary skills to effectively implement the standards of the right to liberty.
The course consists of four core modules:
1. Introduction;
2. Authorised Deprivation of Liberty;
3. Lawfulness;
4. Safeguards.
The course is expected to last approximately two (2) months from the date of launch.
This course will be launched on September 10, 2025, offered through the Council of Europe HELP Platform and the tutor will be Mr. Dren Paca, Prosecutor at the Special Prosecution Office.
