On 27 October 2016, Kosovo Judicial Institute within CTP conducted training on: “Lawsuit, changing the claim and counter claim”.
The purpose of this training was to advance the knowledge of judges regarding the lawsuit, changing the claim and counterclaim.
During this training were discussed legal provisions that regulate the lawsuit, its content, changing the claim and counterclaim, methods of application of these provisions by judges based on the case law. Were also discussed situations and cases where the claim is incomplete and must apply Article 99 of the LCP, in which case the judge must allow filing of a counterclaim, and to what stage of the proceedings is permitted to change the claim.
During the training were addressed the content of the lawsuit, the claim assigned to the main issue and accessing requests, facts upon which the plaintiff based the request and the involvement of several claims in a lawsuit. Whilst, regarding the change of the claim were discussed issues connected with the extension of the lawsuit and filing of another request apart from the existing one, followed by explanation of cases when permitted the change the claim.
The training methods used in the training were a combination of theoretical and practical explanations accompanied by practical examples.
Beneficiaries of the training were judges of the civil division of general department of Basic Courts.
