The right to liberty and safety – ECHR Article 5

June 10-11 2020, Academy of Justice within the Continuous Training program is conducting training on the “The right to liberty and safety – ECHR Article”.

Trainers for this training are: Mr. Bashkim Hyseni, President of the Basic Court in Ferizaj, and Mr. Ismet Ukshini, Prosecutors in Basic Prosecutor in Gjilan.

Purpose of this training is to extend the participants knowledge on the role, structure and positive obligations from Article 5 of the European Convention on Fundamental Human Rights and Liberties (ECHR).

Highlight of this training were: Content of provisions and basic notions of the ECHR Article 5, Main standards in provisions of Article 5 in cases when the person is detained by the state, Specific legal basis and provisions that regulate the situation of detention, Judicial practice and novelties that it brings in relation to implementing the ECHR Article 5.

 During this training it was discusses also on the following: Concept of arbitrariness according to ECHR Article 5, Article 5 of the ECHR on the right to liberty and safety, Existence of the reasonable suspicion, Principle of the legal safety, detention of a minor – Article 5, paragraph 1, point d), Prevention of spreading the contagious diseases, persons of unsound mind, alcoholics, drug addicts or vagrants, Imprisonment with the purpose of expulsion or extradition or with the purpose of preventing unauthorized persons’ entry in country – Article 5 paragraph 1, point f).

Training methodology is based on interactive discussions and elaborated different cases from the judicial practice.

Beneficiaries of this training were judges and prosecutors from the basic and the appeals instance, and professional associates from the region of Prizren and Peja, as well as legal secretaries.
