On April 03, 2013, KJI held a roundtable discussion on the topic “Compensation of damage”.
During this workshop were addressed topics related to: The responsible of causing damage (subjective and objective), material damage and its assessment criteria, non-material damage and its assessment criteria and penalty interest – interest-delay.
This roundtable was followed with the review of problematic cases from the case law. In this case it was found that the current judicial practice reflects different positions with some of the issues related to the principles of liability for damages, statutory institutions, interest-delay and the criteria for determining of the particular material damage especially the satisfaction for non-material damage. Therefore it was recommended that the Supreme Court as soon as possible, in terms of its powers to review and approve the principled positions and legal opinions which will ensure implementation of laws by courts throughout Kosovo.
The beneficiaries of this training were judges of the general Department of Civil Division of the Court of Appeal and general departments of Basic Courts.
