Training Program in non-judicial Institutions - visit of newly appointed Judges and Prosecutors to the Ombudsperson

On February 22, 2023, Academy of Justice within the framework of practical training with non-judicial institutions for newly appointed judges and prosecutors, organized a visit to the "Ombudsperson’s Institution".

In the introductory speech, the Ombudman, Mr. Naim Qelaj initially welcomed the newly appointed judges and prosecutors, describing the purpose of this visit as appropriate, and at the same time highly appreciated the cooperation with the Academy of Justice, to then continue the discussion regarding the mandate, role and competencies of this institution in ensuring and mutual cooperation in the field of justice.

Besides the Ombudsperson Mr. Qelaj, the participants were addressed also by the discussion panel were also Mrs. Suzana Gashi - Director of the Legal Department within the OIK, Mr. Basri Kastrati – Deputy Ombudsperson and Mr. Isa Hasani – Director of the Department for receiving and examining complaints at the OIK.

This program aims to provide newly appointed judges and prosecutors with knowledge regarding the procedures for investigating complaints in citizens' claims of human rights violations, up to the preparation of recommendations for such cases.

It was also discussed about the work of the national mechanism for prevention of torture, reports with recommendations from the handling of complaints and requests, and regular and unannounced visits to all places where persons deprived of their liberty are kept. Judges and prosecutors were also informed about the receipt and review of complaints in the OIK, the relationship between the OIK and the judiciary, and the procedures for receiving complaints and their review if the received complaints, requests or notifications are within the competences and responsibilities of OIK.

Other issues that were addressed in this visit were: the mandate of the Ombudsman as an equality body, the mandate of the Ombudsman as a mechanism for prevention of torture, as well as the mandate of the Ombudsman in relation to the courts and the prosecution offices.

Beneficiaries of the training are the newly appointed Judges and Prosecutors (generation IX) including one members of Bosnian community.
