Drafting and Reasoning of Judicial Decisions

On October 15, 2025, the Academy of Justice, within the framework of the Continuous Training Program and in cooperation with the OSCE, conducted a training on the topic “Drafting and Reasoning of Judicial Decisions.”

Trainers engaged in this activity were Mr. Bashkim Hyseni, Judge at the Supreme Court, and Mr. David G. Campbell.

The main purpose of this training was to enhance the quality of judicial writing and reasoning, serving as an aid to judges in strengthening their professional capacities in legal research, judicial review, and the drafting of judicial decisions.

The methodology of the training included a theoretical treatment of the elements of legal writing, the structure and form of legal acts, interpretation and analysis of facts, and the drafting of main procedural acts. Participants also engaged in a theoretical discussion of procedural provisions referring to legal requirements for drafting judicial acts, followed by practical demonstrations of reasoning techniques and legal writing.

Furthermore, civil and criminal case studies were presented to illustrate methods of legal analysis and presumptive merit determination in concrete cases. Participants actively contributed to discussions, often challenging trainers’ perspectives on the formulation and resolution of complex or alternative legal issues.

Beneficiaries of this training were judges from the Court of Appeal, judges from the Special Department of the Basic Court, and judges from the basic instance courts.
