TPP Module: Criminal Code and Criminal Procedural Code
On 8 June 2012, KJI within the Training Program for Promotion organized the third cycle of the Module: Criminal Code and Criminal Procedural Code on: “Arrest, police detention and detention on remand in short procedure”
Main objectives of this training were that at the end of the session the participants will be able to:
• Distinguish the arrest from police detention;
• Evaluate the effects of the arrest and police detention in the criminal proceedings;
• Understand the importance of the pretrial detention in relation with human rights and fundamental freedoms;
• Dismount the basis of the pretrial detention, and
• Identify difficulties raised during the application of legal provisions of pretrial detention.
During this training were treated details of legal basis of the arrest, police arrest and pretrial detention, duration and the proceedings related to these institutions. All these topics were treated in accordance with the actual law and in the contest of changes and novelties of the draft law of the Criminal Code in relation with the human rights.
While treating these topics was made a comparison of legal basis with regional legal provisions and were given necessary explanations about the reasonable suspicion and ground suspicion for pretrial detention.
Beneficiaries of this session were judges from all regions of Kosovo.
